Navigating PFAS Through the Environmental Due Diligence Process

This presentation outlines a framework for systematically incorporating considerations of Per- and Polyfluoroalkyl Substances (PFAS) chemicals in the preparation of Phase 1 Environmental Site Assessments (ESAs). PFAS, recognized for their persistence, as well as their known and potential environmental and health impacts, pose a growing concern in site assessments and are a consideration as the protocol within the Phase 1 ESA process either considered as a hazardous waste under the Federal Comprehensive Environmental Response and Liability Act (CERCLA) (42 U.S.C. § 9601) or regulated by other Federal or state regulations. The protocol discusses available sources to identify, evaluate, and report on the presence or likely presence of PFAS contaminants and provides environmental professionals a means to integrate and interpret PFAs compatible with the ASTM Standard E1527-21 documentation requirements. The presented framework not only enhances the means and content of the Phase I ESA to address PFAs, but also facilitates informed decision-making for lenders and other stakeholders involved in property transactions, regulatory compliance, and environmental remediation efforts. This presentation contributes to the evolving field of environmental assessment practices by offering practical guidance in navigating the complexities associated with PFAS chemicals.
Mr. Luzkow is an Environmental Professional (EP) with more than 30 years of experience in the environmental sector. His experience includes serving as an environmental risk manager for a national lender, where he developed and administered environmental policy for bank service areas, including commercial real estate, business banking, trust and real estate, special assets, facility operations, as well as bank asset pre-acquisition and lease due diligence. He is currently a Technical Director for Partner Engineering and Science, Inc. as a strategic team member in the financial and commercial real estate sectors by combining his extensive knowledge in environmental due diligence with Partner's national reach of a broad spectrum of services for the management and assessment of real estate to satisfy client objectives.
